PoliNet Website Terms and Conditions
1. Introduction
1.1 The following set out the Terms and Conditions for PoliNet (David Pearce, trading as Autonomy) contactable at 136 Burngreave Rd, Sheffield S3 9DH and email address of datasafety@polinet.co.uk.
1.2 These Terms and Conditions apply in whole to all individuals and entities who use, interact with and visit the PoliNet website (“the Website”) (https://polinet.apptdemo.co.uk/). By visiting and/or interacting with the Website, you agree to the applicability of these Terms and Conditions to the contract between you and PoliNet. For this reason it is important that you take your time and read this document carefully.
1.3 The Website gives visitors information about the PoliNet party and allows visitors to sign up as a member of PoliNet. As a part of PoliNet’s efforts, visitors may also make contributions to PoliNet to support their political party.
1.4 Please note that these Terms and Conditions are governed by, and construed in accordance with, the law of England and Wales. If you are accessing the Website from outside of the United Kingdom you, as a visitor of the Website, are solely responsible for complying with all local laws and regulations.
2. Disclaimer
2.1 Visitors to the Website may make a contribution to PoliNet in 2 ways: a) by making a donation via Chuffed; or b) by signing up as a member of the PoliNet party and paying the monthly membership fee. For information on making a donation or becoming a member of the PoliNet party please see the Website and the relevant sections below.
2.2 By making a donation or paying the monthly membership fee (collectively known as making a “Contribution”), you acknowledge that no promises or guarantees are made in terms of how funds are used. Any Contributions, including both donations and membership fees, will be used as PoliNet continues efforts to develop a new political party.
3. Membership
3.1 You can become a member of the PoliNet party by completing the membership form and providing the following information:
- Title;
- Full name; and
- Address.
3.2 Once completed, you will be directed to a third party website where you will be asked to enter your card details in order to arrange payment of the membership fee. Following the first payment, the membership fee will be taken via the same payment method on a rolling monthly basis unless or until cancelled in line with clause 4.3 below.
3.3 You can cancel your membership at any time by emailing datasafety@polinet.co.uk with 30 days’ written notice. Any membership fee paid prior to the notice period or processed within this notice period is non-refundable.
4. Acceptable Use
4.1 The Website must only be used in compliance with these Terms and Conditions.
4.2 You must not:
- Use the Website in a manner that is unlawful or fraudulent.
- Knowingly cause harm to the Website by uploading, sending or in any way transmitting data that contains any form of virus or malware or any other code designed to adversely affect computers, devices, hardware, software or data of any kind.
- Knowingly cause harm to any other user of the Website.
5. Links to third party sites:
5.1 Links to third party sites may be included or embedded into the Website. However, the inclusion of such links are for information purposes only or to increase PoliNet’s Website functionality and does not imply any endorsement of the sites themselves or those in control of them.
5.2 Unless expressly stated, the third parties that are linked on the Website are not under the control of Autonomy nor do they assume or accept responsibility or liability for the content on these third party sites.
6. Intellectual Property
6.1 All content on the Website, belongs to Autonomy. Intellectual Property owned by Autonomy includes:
- Tradenames;
- Logos;
- Text;
- Design; and
- The underlying software and code.
6.2 Specifically, this prohibits the unauthorised use, download, copying and other activities that would dilute or damage Autonomy’s intellectual property, without express permission from Autonomy.
7. Limitation of Liability
7.1 Autonomy accepts no liability for any damages caused to a visitor either directly or indirectly through the use of the Website.
7.2 Nothing in these Terms and Conditions seek to exclude Autonomy’s liability for death or personal injury caused by negligence (including negligent actions taken by employees, agents or subcontractors), or fraud or fraudulent misrepresentation by Autonomy. Nor does it limit any liabilities otherwise required under law.
8. Indemnity
8.1 As a visitor of the Website you shall defend, indemnify and hold harmless Autonomy against claims, actions or proceedings for losses, damages and costs, including court costs and reasonable legal fees, arising out of or in connection with your use of the Website.
9. Data Protection
9.1 These Terms and Conditions have been drafted in line and in accordance with the UK General Data Protection Regulation (“UK GDPR”), as enacted into UK law by the Data Protection Act 2018 (“DPA’18”).
9.2 Use of the Website is governed by Autonomy’s Privacy Policy and Cookie Policy. These policies are incorporated into these Terms and Conditions by this reference.
10. Changes to these Terms and Conditions
10.1 Autonomy may alter these Terms and Conditions at any time. In the event that alterations are made, such alterations will become binding on you as a visitor upon your first visit to the Website after the changes have been made and gone live.
11. Severability
11.1 If any provisions of these Terms and Conditions are found to be unlawful, invalid or are otherwise enforceable by any court or other authority, those specific provisions shall be deemed served from the remainder of these Terms and Conditions. The remainder of these Terms and Conditions shall be valid and enforceable.
12. Law and Jurisdiction
12.1 These Terms and Conditions, and the relationship between Autonomy and visitors of the Website (whether contractual or otherwise) shall be governed by and construed in accordance with the law of England and Wales.
12.2 Any disputes concerning these Terms and Conditions, the relationship between the visitors of the Website, or any matters arising therefrom or associated therewith (whether contractual or otherwise), shall be subject to the jurisdiction of the court of England and Wales.
